1. Acceptance of terms
These Terms & Conditions are an agreement between you and NATechsys Intelligent Systems Private Limited (“NATechsys”, “we”) for the DiveFlow mobile app, administration tools and website (the “Service”). If you use DiveFlow for a dive center, you confirm that you are authorized to accept these terms for it. If you do not agree, do not use the Service. Please also read our Privacy Policy.
2. About DiveFlow
DiveFlow is a software tool for managing a dive center’s students, registrations and forms, courses, team and invoices. It does not itself certify divers, replace qualified diving instruction or supervision, provide medical advice, or guarantee that any form, record or process satisfies the requirements of a particular training agency, insurer or regulator. Your dive center remains responsible for its operations, its safety practices and its compliance with applicable laws.
3. Eligibility and account registration
DiveFlow is for dive-center owners and their authorized staff who are legally able to enter into this agreement. To register you must provide accurate and complete information, including a phone number you control. Verification codes are sent to that number by SMS.
4. Dive-center account approval
New dive-center registrations are reviewed by our team before the account is activated. We may approve or reject a registration, and may ask for further information. Until a registration is approved the app cannot be used for dive-center operations. Approval does not by itself start a subscription or trial.
5. Account security and authorized use
You are responsible for your phone, password and verification codes and for everything done through your account. Do not share them. Owners decide which team members get access and what each can do, and are responsible for their team’s use. Tell us promptly at info@natechsys.com if you suspect unauthorized access.
6. User responsibilities and accuracy of information
You are responsible for the information you or your team enter, including student details, signatures, medical questionnaire answers and invoices, and for keeping it accurate and up to date. You must have the right (including any consent from participants or, for minors, parents or guardians) to enter that information into DiveFlow.
7. Subscription plans and free-trial terms
- Eligible dive centers can start a 3-Month Free Trial (3 months) after their registration is approved. The trial is offered once per dive center and owner, cannot be restarted or repeated by registering again, and its features and limits depend on the trial package we have configured.
- No payment is requested in the app to start the trial. Payment cannot currently be made inside the app.
- After the trial, or if a subscription expires, continued access requires a plan arranged with us. Access may be restricted until then; your information is not deleted for that reason.
- Plan features, limits, prices and billing periods are agreed with you when a plan is arranged and may be changed for future periods with notice.
8. Fees, renewals and cancellation
Fees for paid plans are communicated to you before you commit, are charged for the period agreed, and are recorded by us when payment is received. Renewals are arranged with our team and are not charged automatically through the app. You may stop using DiveFlow or ask us to close your account at any time (see section 13); fees already paid for a period are not refundable unless we have agreed otherwise in writing or the law requires it.
9. Service availability and maintenance
We work to keep DiveFlow available and reliable but do not promise uninterrupted or error-free operation. We may perform maintenance, update or change features, and suspend access where necessary for security or legal reasons.
10. Intellectual property
DiveFlow, its software, design, logos and content belong to NATechsys or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for your dive center’s operations while these terms apply. You may not copy, modify, reverse engineer or resell the Service. You keep ownership of the content and records you enter, and give us the permission needed to host, process and display them to provide the Service.
11. Uploaded content and data responsibilities
You are responsible for the images, signatures and other content you add. Do not upload anything unlawful, infringing or harmful. You are responsible for exporting or keeping copies of records you need, such as the PDFs you generate.
12. Acceptable use
You must not misuse DiveFlow, including by attempting to access other dive centers’ information, interfering with the Service or its security, using it to send unlawful or unsolicited messages, creating accounts with false information, or trying to obtain another free trial after one has been used.
13. Account suspension, termination and deletion
We may suspend or end access if these terms are breached, an account is used unlawfully or insecurely, a registration is not approved, or a subscription is overdue or expired. You may ask us to delete your account at any time at our account deletion page. Deleting an account is permanent and differs from suspension or deactivation. Some records may be retained where the law or legitimate security, financial or dispute-resolution needs require it, as described in the Privacy Policy.
14. Third-party services
DiveFlow relies on third-party services such as SMS delivery, cloud storage and messaging apps (for example WhatsApp for support). Their availability and terms are outside our control, and your use of them is subject to their own terms.
15. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including fitness for a particular purpose, and we are not liable for indirect, incidental, special or consequential loss, loss of profits or data, or for diving incidents, injuries or decisions made by dive centers, instructors or participants. Nothing in these terms limits liability that cannot be limited by law. Our total liability for any claim relating to the Service is limited, to the extent permitted by law, to the fees you paid us for the Service in the three months before the claim arose.
16. Changes to the terms
We may update these terms. The “Last updated” date shows the latest version, and we will give additional notice of material changes where appropriate. Continued use of the Service after a change means you accept the updated terms.
17. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute relating to them is subject to the jurisdiction of the competent courts in India.
